These general conditions of sale apply to the purchase of products of the brand The12Italy, made by users via the e-commerce website www.the12italy.com.
All products and prices detailed on the website constitute an offer to the public for the purposes and within the limitations and modes stipulated by the website itself and in the following terms and conditions.
All procedures regarding the sale, delivery, and payment are listed in detail in the various sections of the website and are considered an integral and essential part of this contract.
Conditions applicable to individual orders will be those stipulated on the website at the time the order was placed. Any new conditions will be effective from the time of publication on the website and will only be applied to purchases concluded subsequently.
In order to make a purchase via the website, the consumer must be an adult (over 18) and have legal capacity, which the consumer declares is the case.
Any communication between the customer regarding and/or related to the purchase of products, including any claims, complaints and inquiries concerning the purchase and/or delivery of products, the exercise of the right of withdrawal etc, should be sent to the seller using the contact details and the procedure indicated on the website to the email address email@example.com.
The Seller undertakes to update the information and images on the website, as the product range on offer may be updated or subject to changes.
Products are sold with the characteristics described on the website.
The seller reserves the right to change these general conditions of sale at any time at their discretion, without obligation to provide site users with any prior notification. Any modifications made will be effective from the date of publication on the website and will apply solely to sales concluded after this date.
Prices, products on sale on the website and/or their characteristics are subject to variation without prior warning. Before sending the order, the customer is invited to check the final purchase price.
The website can be accessed from anywhere in the world. Nevertheless, products available on the website can be purchased only by users who request delivery to one of the countries listed on the website.
When the Customer has placed an order on the Website, a purchase agreement has been entered into between the Customer and the Seller. We ask to the Customer to save the order confirmation for any future contacts with our customer service. The order confirmation is also the receipt that the purchase has been completed.The Customer is responsible for ensuring that the information provided, such as email, name and address is correct. The purchase order sent to the Seller from the customer via the website has the value of a contractual proposal and is regulated by these general conditions of sale, which constitute an integral part of the order itself and which the customer, by sending the order, is obliged to accept fully and without reserve.
Before proceeding with a purchase by sending the order, the customer will be asked to carefully read these general conditions and the information regarding the right of withdrawal
Prior to confirmation of the purchase, the customer will see a summary of the unit price of each product chosen, the total cost in the case of more than one product and the transport costs.
Every contract for the purchase of products is considered concluded when the customer receives confirmation of the order from payments system and Francesca Bonicolini has been noticed too.
The price of products is that indicated on the website at the time of sending the order. Prices are inclusive of the cost of standard packaging and VAT (where applicable) but do not include delivery costs, which are calculated prior to confirmation of the order by the seller and which the customer undertakes to pay in addition to the prices indicated on the website.
The customer must pay the seller the total price as shown on the order and/or the order confirmation.
Payments for products purchased on the website must be made at the time of ordering by PayPal or Stripes. Payments with Paypal will require 10% extra price. The customer expressly accepts that the contract with the seller comes into force at the moment the cost of the product or products purchased is credited to the account of the seller.
Gift cards are valid for two (2) years from the date of issue. After the expiry date, the card has lost its value and cannot be used as payment or reactivated, nor can any remaining value be reimbursed. Gift cards cannot be exchanged for cash. Keep your card safe. Lost or stolen cards will not be replaced.
Virtual services (cooking classes, tutorials, consultancies)
For virtual Services, are valid the same rules as standard order.
For virtual classes and tutorials, you will receive the list of ingredients and tools once booked. The Seller and the Customer will set together a day and a time considering availabilities of both and time zone difference.
Cooking classes in presence
For Cooking classes in Presence, are valid the same rules as standard order. The Seller and the Customer will set together a day and a time considering availabilities of both. If days available for the Customers are already fully booked and there is no other way to honor the purchase, the Seller will refund the total amount.
Orders are usually prepared and shipped within 7 working days (Mon-Fri), unless otherwise stated. After 20 days, if order is not yet shipped, the customer can cancel the order.
Shipping time vary depending on which country items should reach, unforeseen situations, local slowdowns, postoffice/forwarder’s delays, congestions during special times of the year.

The shipping costs depend on the different type of shipping you chose, the country of destination items should reach, the weight and measure of the parcel. Shipping of the products ordered by the customer will be executed in the manner selected by the customer from the available options indicated on the website at the time of ordering

If a package has been delivered directly to the Customer’s mailbox and you don’t pick up the package from a specific delivery point or post office indicated in the mail you receive, the Seller has the right to charge the Customer a fee for freight and administrative costs.
In the event that the packaging of products ordered by the customer arrives at the destination clearly damaged, the customer is invited to refuse the delivery by the courier or to accept the delivery “with reservations”, specifying on the delivery document the type of damage occurring.
The Seller doesn’t take any responsibility in the delivery times as it’s not upon our managing; we deliver using the forwarder you chose during check-out and we cannot guarantee if items arrive or it arrives within a certain date. The Seller doesn’t take any responsibility if parcel is lost or delivered to a wrong address. The Seller or the system will provide you tracking numbers for tracked shipment only and you have to monitorize the parcel by yourself.
No refunds or second shipments will take place for lost packages or delivered to wrong addresses. Refund will be placed if parcel lost comes back: in this case we issue a credit for other purchases and the amount include the item only, shipping costs and extra returning fees already paid by us are not refundable.
When purchasing products on the Website, the Customer has a 14-day withdrawal period. This means that the Customer has the right to cancel the purchase by notifying the Seller accordingly within 14 days from when the Customer or their representative received the product ordered (withdrawal period). The Customer is responsible for the condition of the product after the Customer has received the product and during the return shipping. The product shall be returned within 14 days from the date when The Seller was notified of the withdrawal. The product shall be sent in its original condition, well packaged, in the original package. Make sure the products are unused and in the same condition in which they were delivered to you. If not, a calculated fee will be taken out for restoration. Place the item(s) in the original shipping box, or any other solid carton box. Close the box and tape it securely. Every withdrawls need a motivation.
To return your purchase, you should mail it to the Seller at this address: FRANCESCA BONICOLINI – TERZA STRADA LUNGARNO 431/B – 52028 TERRANUOVA B.NI (AR) – ITALY – The Customer is responsible for the transport risk and shipping cost or returning your purchase. Shipping costs we paid for shipping to the customers will be detracted from the refound. Depending on where you live, the time it may take for your exchanged product to reach you, may vary.
You should consider using a trackable shipping service or purchasing shipping insurance.
We strive to repay the amount as soon as possible, yet no later than within 14 days from the date we received your return. Please note that we must have received the goods as a return or a delivery receipt must be presented on request before a refund can be issued. As soon as your return has been received by us and your refund has been initiated, you will receive a confirmation of this by e-mail. Depending on payment method it might take 2-5 business days from when you received the return confirmation, before you get your refund. Extra costs and fees we have to pay for your returning items will be hold from refound.
The right to withdrawal is not permitted in the case of:
- purchase of sealed packages which have been opened by the customer;
- bespoke or personalized packaging;
- goods which by their nature cannot be returned, or which risk rapid deterioration or damage.
TOLL & CUSTOM FEES
In the shopping cart you can see the total cost including items, shipping costs, fees and method of payment, but excluding custom fees and taxes applicable in your country. The Seller does not take responsibility for any added fees or taxes as custom fees and duties are the customer’s responsibility. Before placing an order, the customer is invited to consult the relevant authorities in their country of residence or the destination of the products for information regarding any duties or taxes applicable in these countries.Any other further cost, duty and/or tax applicable in a given country on any product ordered under these general conditions of sale is payable solely by the customer. The customer accepts that lack of knowledge about costs, duties and/or taxes at the time of sending an order to the seller does not constitute a cause for withdrawal from this contract and that the seller will under no circumstances be liable for any such costs.
Any dispute regarding the application, execution, interpretation or violation of the online contract between the customer and the Seller is subject to Italian jurisdiction, where the Seller Company is registered.
